Spanish-America War

Destruction of the Maine,

(February 15, 1898), an incident preceding the Spanish-American War in which a mysterious explosion sank the U. battleship Maine in the harbour of Havana. The destruction of the Maine was one of a series of incidents that precipitated the United States’ intervention in the Cuban struggle for independence from Spain, which had begun in 1895

On April 25, 1898, the United States declared war on Spain and the commander of the U. Asiatic Squadron, Commodore George Dewey was sent to engage the Spanish navy in the Philippines. Dewey attacked the Spanish fleet on the morning of May 1, 1898 from his ship USS Olympia. The battle lasted only a few hours resulting in the complete destruction of the Spanish fleet at Manila Bay. The American fleet suffered only minor damage

At the same time that the Philippines were fighting for independence, Cuba, also a colony of Spain, was trying to liberate itself from Spanish rule. Cuba, however, had the backing of the United States. When the American battleship, USS Maine, sank in the Havana harbor, war between the United States and Spain became imminent.

Philippine-American War (1899-1902)

war between the United States and Filipino revolutionaries from 1899 to 1902, an insurrection that may be seen as a continuation of the Philippine Revolution against Spanish rule. The Treaty of Paris (1898) had transferred Philippine sovereignty from Spain to the United States but was not recognized by Filipino leaders, whose troops were in actual control of the entire archipelago except the capital city of Manila. Although an end to the insurrection was declared in 1902, sporadic fighting continued for several years thereafter.

Our country was placed under a military government until 1901 with the passing of the Spooner Amendment, putting an end to the military rule in the Philippines and replacing it with a civil government with William H. Taft as the first civil governor.

Spooner Amendment, congressional amendment to the Army Appropriations Act of 1901 that called for the end of the U. military government in the Philippines. By the terms of the Treaty of Paris (December 1898), sovereignty over the Philippine Islands had passed from Spain to the United States.

Treaty of Paris

  • The Spanish-American war officially ended with the Treaty of Paris on December 10, 1898. However, the American government was only interested in Cuba's independence, not that of the Philippines. By the Treaty, Cuba gained its independence and Spain ceded the Philippines,

JONES LAW

  • In order to improve and widen our knowledge about running a government, US congress ratified the Jones law.
  • William Atkinson Jones proposed the Jones Law or The Philippine Autonomy Act and it was inaugurated on August 29, 1916.
  • This was the first step towards the autonomy of the Philippines.
  • Jones Law replaced cooper act as the basis of the Philippine government.
  • in the preamble of the Jones law. states that the Philippines will have freedom once it has a stable government.

The jones law also provided rights for the people of the Philippines (bill of rights)

One of the rights are

  • Freedom of speech and expression - That no law shall be passed abridging the freedom of speech or of the press, or the right of the people peaceably to assemble and petition the Government for redress grievances.
  • Freedom of Religion - That no law shall be made respecting an establishment of religion or prohibiting the free exercise thereof, and that the free exercise and enjoyment of religious profession and worship, without discrimination or preference, shall forever be allowed; and no religious test shall be required for the exercise of civil or political rights. No public money or property shall ever be appropriated, applied, or used, directly or indirectly, for the use, benefit, or support of any sect, church, denomination, sectarian institution, or system of religion, or for the use, benefit, or support of any priest, preacher, minister, or other religious teacher or dignitary as such.
  • Rights of person accused of crime - That in all criminal prosecutions the accused shall enjoy the right to be heard by himself and counsel, to demand the nature and cause of the accusation against him, to have a speedy and public trial, to meet the witnesses face to face, and to have compulsory process to compel the attendance of witnesses in his behalf.
  • Due process and eminent domain - That no law shall be enacted in said Islands which shall deprive any person of life, liberty, or property without due process of law, or deny to any person therein the equal protection of the laws. Private property shall not be taken for public use without just compensation.

this law also provided for the existence of three branches of government

Hare-Hawes-Cutting Act

  • Proposed by butler Hare, Missouri Senator Harry Bartow Hawes, and New Mexico Senator Bronsom M. Cutting.
  • The Hare–Hawes–Cutting Act was the first US law passed setting a process and a date for the Philippines to gain independence from the United States.
  • The bill was passed by the Senate in December 1932 but was vetoed by Pres. Herbert Hoover. Congress promptly overrode his veto, and the bill became law on Jan. 17, 1933. The act, however, required approval by the Philippine Senate, and this was not forthcoming. Filipino political leader Manuel Quezon led a campaign against the bill because of provisions in it that allowed the indefinite retention of U. military bases in the islands. It was the result of the OsRox Mission led by Sergio Osmeña and Manuel Roxas. Supported by OSROX mission.

Provision

  • The law promised Philippine independence after 10 years, but reserved several military and naval bases for the United States
  • imposed tariffs and quotas on Philippine imports.

Approval of the Tydings-Mcduffie act

Senator Millard Tydings passed the act in the senate it was approved

Representative John McDuffie Introduced the act in the House representatives it was approved

And President Roosevelt signed it

The Philippine Legislature ratified it on May 1, 1934.

PROVISION OF 1935 CONSTI

  • Salient features of the 1935 Constitution include the following: a bicameral legislature composed of a senate and House of Representatives. The President is to be elected to a four- year term together with the Vice-President without re-election; rights of suffrage by male citizens of the Philippines who are twenty-one years of age or over and are able to read and write; extension of the right of suffrage to women within two years after the adoption of the constitution.

  • Social Justice  Layunin nitong mapanatili ang balanse ng kalagayang ekonomiko at panlipunan sa buong bansa

  • Pagbubukas ng mga pribadong paaralan

  • Pagbibigay ng karapatang makapagaral sa mga matatanda (Adult Education Office)
