IMMIGRATION LAW

FORMATIVE EXERCISE

Please read the following instructions:

This is a voluntary piece of work if you would like a bit of practice/feedback prior to submitting your assessed coursework in January 2021. This formative exercise is aimed at providing brief feedback on technique for the essay style question (Part A of your coursework assessment).

In some lectures and in tutorials 1 and 2 we will focus on technique for answering problem-style questions (Part B of your coursework assessment) and you will receive feedback on short problem-style questions throughout the course.

This exercise is purely for your assistance/practice and its completion (or not) will have no bearing on your mark for the summative assessment.

Write a maximum of 1000 words on one of the following topics.

Please choose one of the following titles:

  1. Evaluate the troubled history of immigration appeal rights for people wishing to come to the UK on a temporary basis to visit family members. What redress currently exists for a visitor refused entry clearance to attend an important family event and is it likely that a human rights argument could be made at a family visitor appeal?

  1. In 2018, the then Home Secretary Sajid Javid when talking about the “ Life in the UK ” test, said “ citizenship is about a lot more than being able to win a pub quiz ”.

In the light of these comments and past criticism of the “ Life in the UK ” test, critically analyse the legal reasoning behind its introduction as well as its current use in the immigration and nationality system and its success in achieving the purposes for which it was intended.

  1. Following her 2015 speech to the Conservative Party Conference, the Institute of Directors accused of " irresponsible rhetoric and pandering to anti- immigration sentiment ". In 2013 Ms May was reported as stating that some immigration judges were “ ignoring Parliament’s wishes ” and “ subverting ” British democracy. These are 2 examples of tensions between politicians and other interested bodies regarding the mechanics of immigration system.

Using these statements as a starting point, critically analyse the relationships between politicians, the media and the legal system and consider the effect that those relationships might have on the implementation of immigration control and on the immigration judicial system.
