5-1 Discussion: Data Privacy Considerations Discussion Question:

The European Union legislation called the "General Data Protection Regulation" (GDPR) provides data privacy protections for consumers and has had a major impact on companies around the world.

In your initial post, address two of the three bulleted questions below.

 What are the general requirements and major impacts of the GDPR, and how does this law differ from data protection legislation in the United States?  How do perspectives on the GDPR differ between consumers and businesses? Do perspectives vary by industry?  Do you think there should be one data privacy law for the entire world?

Balance your discussion by weighing the benefits to international companies with your knowledge of the differences in culture, politics, and government around the world and the importance of the sovereignty of countries.

In your responses to two or more of your peers, address whether you agree or disagree with your peer's opinion and whether there should be global data privacy legislation.

For the consumer, the GDPR gives them more protections against companies that want to use them as an accessible data collection treasure trove that can be used for marketing invasive advertisements to the consumer. What the GDPR does is allow consumers to access data collected on them by companies and ask for it to be deleted which most companies wouldn't want to do. To companies, this is a massive hit to their way of being able to use data from users long term if the said user ends up wanting that data deleted at any point in time. You might have seen a lot of websites when you visit that will ask you to accept cookies to improve your overall experience with the site you are on. This is in part due to them wanting to ask for permission that permission to access the data on your browser that can later be sold to the highest bidders of categorize data tailored to different business models. an article states the following "If individuals are no longer customers, or if they withdraw their consent from a company to use their personal data, then they have the right to have their data deleted."(GDPR: What Is It and How Does It Impact Your Business? n.) If a company is no longer doing business with a customer it's only right that the data they collected from them be scrubbed and no longer in use for said company to profit from. Even if data collection enchants the experience of the product

consent should have always been used first as it is also considered a privacy protection violation if not.

 Do you think there should be one data privacy law for the entire world?

While I do believe in there being a worldwide privacy data law being put in place it's just not possible. Many countries would conflict with each other about what their citizen's data can be used and what can't be used. China is a big opponent of data collection on its citizens but would be very angry if the rest of the world had that data on hand. As some of you may know the US and China ended up having a clash over user data when it came to the popular app known as Tik Tok. China had overstepped its bounds with data collection by taking the data of foreign country citizens that did not belong to them in the first place. This is why the US has banned the App on several military sites and even hit the company with several lawsuits for funneling data into Beijing. To anybody that might have a Tik Tok account teacher or student, I would recommend checking out to see if your state is filing a class action lawsuit against Tik Tok because I'm sure that it will be a while before things get resolved with them with these breaches of pricy of data.
