During the COVID-19 pandemic, the US Department for Health and Human Services made limited exceptions to enforcement of the HIPAA Privacy Rule intended to protect public health and patient-facing healthcare personnel and social workers. The basics of the exceptions are that PHI about patients having COVID-19 can be shared without the patient's consent if it needs to be shared for the patient's treatment, the safety or treatment of others who may be or may have been exposed to the patient, or gathering of data about COVID spread by public health or disaster relief organizations (US Department of Health and Human Services, 2020). This includes sharing PHI about the patient with anyone involved in the care of patients (including family members, guardians, law enforcement personnel having custody of the patient, first responders caring for the patient, etc.) (Office of Civil Rights, 2020). There is a noted duty for healthcare personnel to receive permission if possible and to share the minimum necessary information (Office of Civil Rights, 2020), but not requiring permission increases healthcare personnel's ability to share information if they deem it in the patient's best interest or the interest of another party's safety without violating HIPAA. Enforcement of the HIPAA Privacy Rule was also relaxed surrounding telehealth, including for patients not suffering from COVID-19, and for community testing and vaccination centers/scheduling programs. Exceptions made for telehealth, public health tracking of COVID, and community testing and vaccination sites were reversed in May of last year (Federal Register, 2023).
