COUNTER-AFFIDAVIT
I, ____________, of legal age, married and a bona fide member of the Philippine National Police and presently assigned at Regional Police Security and Protection Unit , _____________, _______, after having been sworn in accordance with the law, do hereby depose and state that:
On January 20, 2022, I received a copy of a Memorandum dated January 19, 2022 issued by the Honorable Office regarding a Notice of Complaint with regards to the submitted daily attendance report from September 2021 to October 2021 of Regional Police Security and Protection Unit (RPSPU) with incurred excessive day-off of personnel, forged signature and failure to correct or take appropriate action for irregularity being committed in his presence by a subordinate which violated the Civil Service Law;
Pursuant thereto, I was directed to submit an answer/counter affidavit within five (5) days from receipt thereof. In compliance with the said memorandum, I hereby respectfully submit my counter-affidavit to justify why no administrative case should be filed against me with regards to the aforementioned complaint;
It is worthy to note that the Province of ______ adopted a 50/50 work scheme on the months of September and October 2021 due to the rise of Covid19 cases particularly in ________ wherein an Enhanced Community Quarantine (ECQ) classification was imposed;
To prevent the spread of the said virus, we were given a schedule of two days duty and two days off. Nevertheless, our schedule was not strictly observed as some of our personnel got infected with the said virus and those who are feeling some Covid19 symptoms, were advised isolate themselves;
In the month of October 2021, I attended the actual exercise of the VIP refresher course/seminar, from October 8, 2021 to October 10, 2021;
That after the said exercise, I reported at our Office for my tour of duty on October 12, 2021. On the following day, I had been experiencing some symptoms of Covid19. Thus, I immediately informed ___________ former OIC-RPSPU, regarding my health condition at that time. He then advised me to observe self- isolation and to report for duty after the symptoms are gone;
I also informed the Barangay Officials of ________, the place where I reside with regards to my health condition and they likewise advised me to observe self- isolation/home quarantine;
In compliance to the advice coming from the former OIC-RPSPU and of the Brgy. Officials of Brgy. ________, I strictly isolated myself at our residence from October 13, 2021 to October 20, 2021;
On October 21, 2021 or a day after the completion of my home quarantine, I immediately reported at our Office for my duty. During the said day, I was informed that I am designated as a member of the Counter Intelligence Team (CIT);
10, on the following day, I was tasked to conduct a counter check the background of a Sangguniang Bayan member who is asking for police security and protection at our Office;
Afterwards, I took my day off on October 27 to 28, 2021. I reported again for duty on October 29, 2021 and I asked the permission of ________, to conduct further follow background investigation regarding the availment of Police Security and Protection Assistance applied for by the Sangguniang Bayan member;
Hence, it is my humble position that I did not incur excessive day-off, but the same was due to the foregoing reasons. Moreover, I have no intention to violate and/or disobey the laws, rules and the legal orders and directives coming from the higher officers of the Organization;
Furthermore, let it be emphasized that all the signatures under my name which was reflected on the daily personnel accounting report submitted by our unit, RPSPU, were my true signatures and I was the one who signed the same;
By and large, I have executed this Counter-affidavit such that I may prove that the facts and circumstances would definitely show that I have not committed the acts or omissions complained of;
In fine, I am optimistic that this Honorable Office, by exercising great caution and of sound judgment, would consider this Counter Affidavit and the attached controverting evidence meritorious and that it would render a resolution dismissing the complaint for lack of merit.
